Q - What is a conditional offer?
A - If you receive a NIP & send it back with the driver's details & that person admits the offence, if they are eligible, they will be sent a Conditional Offer. Basically, it is an offer from the police, stating that if they agree to pay a £60 fine & surrender their licence to have 3 points endorsed on to it, the matter will be dropped.
Q - I was the driver and would like to plead mitigation in the matter. I do not know who was driving my vehicle when the offence took place. What do I do?
A - As the owner / nominated person or employer, you have a duty to identify the driver. If not, the owner / nominated person or employer will be taken to court.
Q - Are my human rights infringed if I respond to the paperwork you send out?
A - The Human Rights Act does not affect you when you return this Notice. Primary legislation dictates that you are still obliged to provide the information requested. Failure to do so will result in prosecution.
Q - What happens if I cannot produce full payment and a valid driving licence?
A - You must take the matter to court & explain your circumstances.
Q - I do not see any speed limit signs. How do I know what the limit is?
A - In most cases you will be in a 30mph zone. If it is a built up area, with houses, places of work, street lighting & people around, assume it's a 30 unless you see regular signs telling you otherwise.
Q - I cannot find my driving licence, what do I do?
A - Contact DVLA & request a new one as soon as you recognise you need one. As you have 28 days to respond to the NIP & 28 days to respond to the Conditional Offer, this should leave you with plenty of time to send it back.
Q - I don't have a photocard licence, what do I send in?
A - Your old paper licence.
Q - What do I do if my name / address details have changed, but my DVLA licence has not yet been updated?
A - It is an offence not to inform DVLA of any changes of contact details & you may be fined through DVLA for this. As soon as the traffic offence is dealt with, you should apply for a replacement licence.
Q - I passed my driving test less than 2 years ago. Can I still accept a fixed penalty offer?
A - Yes.
Q - My vehicle was nowhere near where the camera says it was at the time, what do I do?
A - Write a letter into CTO explaining your mitigating circumstances. A Police Officer will then investigate your case.
Q - I have been caught speeding, but think I have a good reason for doing it, what do I do?
A - We advise you to take your case to court & explain your circumstances there.
Q - My driving licence has been stolen, what do I do?
A - Report it to the Police & contact DVLA for a new one.
Q - What happens if I have a foreign driving licence that wasn't produced by DVLA?
A - Please state this clearly on your Section 172.
Q - There is a mistake on the notice, what do I do?
A - Contact CTO immediately & inform them. They will then advise you on how to progress.
Q - I sold the vehicle prior to the offence, what do I do?
A - When you send back your NIP / 172, fill out the box which states you sold the vehicle with the person's details of whom you sold it to. Whenever you sell a vehicle, it is your responsibility to inform DVLA that it is no longer in your possession.
Q - What happens if I ignore the notice that you sent out to me?
A - Eventually, you will be sent a court summons.
Q - Is it possible to go on a speed awareness course?
A - For some people it may be possible. Once you have completed and returned your Section 172 form on the back of your NIP, you will be sent a letter informing you whether or not this is an option for you.
Q - Can I just pay a higher fine and not have any points put on my licence?
A - No. you may be eligible to be offered a Speed Awareness Course, instead of the points, depending on the speed you were driving at.
Q - Why do you hide cameras just to catch people out?
A - Our cameras are never hidden. They are clearly signed, painted yellow & all locations available on our website.
Q - Can I have a copy of the photograph?
A - Please contact CTO and request one. You may be charged.
Q - I was only a few miles an hour over the limit, how come I am being prosecuted?
A - DRIVESAFE works above the ACPO guidelines, allowing motorists adequate lee-way over the limit. Remember, the limit is the limit & you should stick below it, so in effect, even 1mph over is breaking the law. You may be eligible to attend a Speed Awareness Course.
Q - I have had a clean licence for over 20 years, can you not give that consideration instead of putting points on my licence?
A - No. You may wish to offer this to the court as mitigation.
Q - What happens if I plead not guilty?
A - You will be summonsed to appear in court.
Q - Can I have a copy of the calibration certificates?
A - These will be available if you take the case to court.
Q - Can I appeal against this notice?
A - You can take your case to court if you wish to appeal against it.
Q - How many points on my licence am I allowed before I get disqualified?
A - Once you reach 12, you will normally be disqualified.
Q - Do you enforce a zero tolerance policy?
A - As we allow adequate lee way over the limit, we enforce a zero tolerance policy to anyone travelling above these levels.
Q - I think the mobile vehicle was parked illegally, does this invalidate my ticket?
A - No.
Q - My NIP arrived over 14 days after the offence, is it still valid?
A - If you are not the registered keeper of the vehicle, but were driving at the time of the offence, then it may be possible that more than 14 days has elapsed, due to the length of time it takes for the Registered keeper to send us your details. If you are the registered keeper and it was you driving, then yes.
Q - What happens if I am caught more than once in the same journey?
A - You will be sent NIP's for each time the camera was triggered.
Q - Who is it that decides a camera should be used in a certain place?
A - It is the decision of the Local Authorities, and Partnership members based on the number of serious injuries incurred from road traffic collisions and the speed of the vehicles at the particular location.
Q - Is it true that an offence isn't valid if the camera isn't yellow?
A - No.
